10-16-09-08. Additional conditions. 1. The North Dakota Lottery does not warrant or guarantee product quality or availability of products. 2. The North Dakota Lottery is not responsible for any prizes lost, damaged, or stolen during shipment, pickup, or use. 3. The North Dakota Lottery is not responsible for any damages, injury, or loss of life resulting from any item awarded. 4. Players are responsible for any applicable taxes. 5. Players are solely responsible for maintaining and keeping account information current or accurate. The North Dakota Lottery assumes no responsibility or liability whatsoever for technical or computer malfunctions or for the player's failure to keep account information current. 6. By participating in the North Dakota Lottery Players Club, each player and the player's heirs, legal representatives, and assignees agree to indemnify, defend, release, and discharge the North Dakota Lottery, Scientific Games, LLC, MDI Entertainment LLC, the state of North Dakota, their employees, officers, and directors, from and against any loss, claim, damage, suit, or injury arising out of or relating to the North Dakota Lottery Players Club products or any action taken pursuant to these rules. 7. No one under eighteen years of age and no one otherwise prohibited by North Dakota Century Code section 53-12.1-08 from playing North Dakota Lottery games is eligible to participate in the Points for Prizes program.
