Defective casing or cementing.

43-02-03-22. Defective casing or cementing. 1. In any well that appears to have defective casing or cementing, the operator shall report the defect to the director verbally and file a well sundry notice if required by the director. To properly evaluate the condition of the well, the operator shall diligently conduct tests or run logs as approved or required by the director. Prior to attempting remedial work to correct any defect, the operator shall obtain approval from the director. The director is authorized to require subsequent pressure tests and logs to verify casing integrity if its competence is questionable. The director may allow the well condition to remain if correlative rights can be 32 protected without endangering potable waters. The well must be properly plugged if requested by the director. 2. After any attempted or completed remedial work, a report on the operation must be filed on a well sundry notice with the director pursuant to section 43-02-03-31. 3. Any well with open perforations above a packer is considered to have defective casing.
