58-01-01-01. Organization and functions of the parks and recreation department. 1. Organization of department. a. History. In 1965, the legislative assembly created the state outdoor recreation agency and the North Dakota park service. They operated as separate entities until the 1977 legislative assembly combined them into the parks and recreation department. In 1991, the legislative assembly merged the department with the tourism promotion division, formerly a division of the North Dakota economic development commission. The two divisions were split by the 1993 legislative assembly, and two separate agencies were created, the parks and recreation department and the tourism department. b. Department counsel. The attorney general of North Dakota is the ex officio attorney for the department. 2. Functions of the department. The parks and recreation department shall plan and coordinate government programs encouraging full development, maintenance, and preservation of existing and future state parks, outdoor recreation areas, campgrounds, and nature preserves. The director of the department is appointed by and shall serve at the will of the governor. 3. Inquiries.
