58-02-08-35. Negligent operation of a snowmobile or off-highway vehicle. A snowmobile or off-highway vehicle is operated in a negligent manner when it is operated at a speed greater than is reasonable or proper under all the surrounding circumstances, when it is operated with want of ordinary care and diligence under all the surrounding circumstances, or when it is operated in a way that is not reasonable or prudent under the conditions or without regard to the actual or potential hazards then existing. Any person who violates this section is guilty of a class B misdemeanor. History: Effective May 1, 2011.
